These Terms of Service ("Terms") govern your access to and use of the Warrior Afya Network website at warriorwellness.com (the "Site") and any services, programs, or content offered through it. By accessing the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Warrior Afya Network

Warrior Afya Network is a non-profit community organisation registered in Kenya. Our mission is to provide holistic support — physical, mental, and social — to cancer patients, survivors, and caregivers. The programs and content on this Site are offered in that spirit.

2. Acceptable Use

By using this Site, you agree to the following:

You May

• Access and browse the Site for personal, non-commercial purposes.
• Submit forms to register for programs, make enquiries, or make donations.
• Share links to our public content for educational or advocacy purposes.

You May Not

• Use automated tools, bots, crawlers, or scrapers to access or copy content from the Site without prior written permission.
• Submit false, misleading, or fraudulent information through any form.
• Impersonate another person, organisation, or representative of Warrior Afya Network.
• Use the Site to distribute spam, unsolicited communications, or malicious content.
• Attempt to gain unauthorised access to any part of the Site, its servers, or associated databases.
• Reverse-engineer, decompile, or attempt to extract the source code of any part of the Site.
• Use any content, images, or branding from this Site without express written permission.
• Use the Site in any manner that could damage, disable, overburden, or impair it.

Violation of these terms may result in immediate termination of your access and, where appropriate, referral to relevant authorities.

3. Medical Disclaimer

Warrior Afya Network does not provide medical services through this website. References to specific treatments, therapies, or health practices are educational and do not constitute medical recommendations. Reliance on any information provided on this Site is solely at your own risk.

4. Intellectual Property

All content on this Site — including text, images, logos, graphics, videos, and program descriptions — is the property of Warrior Afya Network or its contributors and is protected by applicable Kenyan and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Site without prior written consent from Warrior Afya Network.

5. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Warrior Afya Network, its directors, officers, employees, volunteers, and partners shall not be liable for:

• Any loss of data, revenue, goodwill, or profits, whether or not foreseeable.

Our total liability to you for any claim arising from your use of the Site shall not exceed KES 5,000 (five thousand Kenya Shillings).

9. Termination

Warrior Afya Network reserves the right to:

• Suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to the organisation, its members, or the public.
• Modify, suspend, or discontinue any part of the Site at any time without liability.
• Refuse registration to any program applicant at our sole discretion.

Upon termination, your right to use the Site ceases immediately. Any provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall continue to apply.

10. Dispute Resolution

These Terms and any disputes arising out of or in connection with your use of the Site shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

Step 1 — Good Faith Resolution

Before initiating any formal legal proceedings, both parties agree to first attempt to resolve the dispute informally by notifying the other party in writing and engaging in good-faith discussions for a period of no less than 30 days.

Step 2 — Mediation

If informal resolution fails, the parties agree to attempt mediation administered through a mutually agreed mediator in Nairobi, Kenya, prior to initiating litigation.

Step 3 — Litigation

If mediation is unsuccessful, any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya, sitting in Nairobi.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to this page, with the "Last updated" date revised accordingly. Your continued use of the Site after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.
